The Delhi government has introduced a major change that will make property transactions through GPA much stricter. According to the government, the move is aimed at preventing stamp duty evasion, curbing land fraud, and protecting government revenue. For years, properties worth ₹10 lakh to ₹50 lakh in many unauthorized colonies were commonly bought and sold through GPA instead of a registered sale deed. The biggest reason was the huge difference in costs. While registering a ₹25 lakh flat could require around ₹2–2.5 lakh in stamp duty and registration charges, the same transaction could often be completed through a GPA by paying only around ₹50,000 in stamp duty. This allowed both buyers and sellers to save substantial amounts on taxes and registration fees. The government believes this practice has caused significant revenue loss and has also encouraged property fraud, illegal land dealings, and disputes over ownership. Following directions from Chief Minister Rekha Gupta, all Sub-Registrars have now been instructed to thoroughly examine every GPA document presented for registration. Officials will specifically check whether the document mentions any exchange of money, transfer of possession of the property, whether the GPA has been made irrevocable, or whether it grants permanent rights to sell, gift, transfer, or mortgage the property. If any of these conditions are found, the document may no longer be treated as a simple GPA. The government has also introduced another major restriction. A GPA executed in favor of anyone other than close blood relatives—such as parents, spouse, son, daughter, brother, or sister—will no longer be registered directly by the Sub-Registrar. Instead, such cases must be referred to the Collector of Stamps. The Collector of Stamps will determine whether the document is merely a General Power of Attorney or is effectively functioning as a sale deed (conveyance deed). If it is found to be equivalent to a sale transaction, the parties will be required to pay the full stamp duty and registration charges applicable to a property sale. The Collector has been directed to dispose of such cases within 30 days. In exceptional circumstances, this period may be extended up to three months, but only through a reasoned written order. No GPA of this nature will be registered unless the Collector's approval is obtained and the prescribed stamp duty has been paid. Chief Minister Rekha Gupta has also made it clear that if any Sub-Registrar violates these rules by registering such a GPA without referring it to the Collector of Stamps, strict disciplinary action will be taken against the concerned official. The new rules are expected to significantly impact property transactions in Delhi's unauthorized colonies, making it much harder to avoid stamp duty and registration charges through GPA-based property deals.
