Justiciabilidad de los Derechos Económicos, Sociales, Culturales y Ambientales (SIDH)

Article 26 of the American Convention is the only mention this treaty makes of economic, social, and cultural rights, and it does not include any specific rights. For years, the Inter-American Court interpreted this to mean that the Court could not declare violations of this article. This changed in 2017, and since then, the Inter-American Court has held that it can indeed declare violations of economic, social, cultural, and environmental rights. In this discussion, we will examine the reasoning the Inter-American Court uses to consider economic, social, cultural, and environmental rights justiciable. I interviewed Pablo González Domínguez, who holds a PhD in International Human Rights Law from the University of Notre Dame. He currently works as a lawyer in the Secretariat of the Inter-American Court of Human Rights. Pablo has written several articles on international human rights law, including the article "The Contributions of the Cuscul Pivaral et al. v.
