#Live TCP: Vacancies Must Be Filled Through Elections, Not By Law; “By Law, It Violates the Constitution, It Would Mean Co-Governing” The president of the Plurinational Constitutional Court (TCP), Verónica Prudencio, stated that vacancies among magistrates on the TCP must be filled through elections, not by law. “Elections must be called to fill vacancies on the TCP… magistrates must be elected by popular vote… we must all comply with the Constitution… The Constitution must be respected; elections must be by vote, not by law in the TCP,” said the TCP authority. The magistrate is concerned that there are plans to appoint authorities to the TCP through a bill rather than by popular vote; she believes that other mechanisms are contrary to the Constitution. “That would mean co-opting them to co-govern, through the instrumentalization of constitutional justice,” she said. She urged government authorities, particularly the executive branch, to comply with the Constitution and call for elections in the five remaining departments to elect the Constitutional Court (TCP) authorities. “It is concerning that they are trying to co-opt the TCP through appointments by law… they must call for supplementary elections in these five departments,” she said. Regarding the budget, the magistrate stated that the TCP also requires more funding.
