Is it legal to drive a 45 km/h moped in Spain with a German insurance license plate? Fines of up to €500 or more are possible. While a German insurance license plate proves that liability insurance exists (theoretically valid throughout the EU), the problem lies with the registration. According to the Vienna Convention on Road Traffic, a vehicle in international traffic requires an official registration certificate (Part I, the "vehicle registration document"). However, a 45 km/h moped is exempt from registration in Germany and only has a national operating permit (ABE) or a Certificate of Conformity (CoC). The Spanish police often do not recognize these German national documents, in conjunction with the small metal license plate, as valid registration. In Spain, mopeds have an official, government-issued (yellow) license plate and genuine registration documents. The Guardia Civil or Policía Local often complain that the moped is being driven "without valid registration." The standard fine for this in Spain is a hefty €500. In some cases, the vehicle can even be impounded or confiscated on the spot. Appealing the fine is tedious, lengthy, and rarely successful. There are no exceptions for tourists. Mopeds and scooters must be registered in Spain; a German insurance license plate is no longer sufficient. You can't voluntarily register a 20 km/h scooter in Germany, but you can register a 45 km/h moped. And that seems—in my opinion—to be the best way to avoid a fine in Spain (unless you register and insure your moped/scooter in Spain. And that's precisely what didn't work for me). Riders of scooters with a top speed of up to 20 km/h and German insurance license plates can also receive a fine. These vehicles can also (theoretically) be registered in Spain. For mopeds with an insurance license plate, license plate lights are not legally required. According to Section 27 Paragraph 4 Sentence 2 of the Vehicle Registration Ordinance (FZV), insurance license plates for mopeds, scooters, and light quadricycles are explicitly exempt from this requirement. Voluntarily registered vehicles, however, must have license plate lights. Furthermore, the license plate should not be wider than the vehicle itself. In Germany, these vehicles are limited to 20 km/h and receive the small insurance sticker. Spain allows speeds up to 25 km/h but significantly tightened its regulations at the beginning of 2026. New legal situation: In January 2026, the Spanish Directorate General of Traffic (DGT) introduced a mandatory national register. All e-scooters (called VMP in Spain) must now be officially registered, require a Spanish digital certificate, and have their own identification plate on the vehicle. In practice: Your German insurance sticker will not be accepted. The scooter must be registered in the Spanish DGT register and insured through a Spanish policy. The fine: If you are stopped without valid Spanish registration and insurance, you face fines between €200 and €610.
