Legal entities are subdivided into public and private legal entities. This topic is extremely important in both Civil Law and Administrative Law. Before discussing legal entities under public law, I need you to keep in mind the difference between public and private law. Public law governs relationships in which the State is a party or has a significant interest. The relationship between the State and a private individual is not one of equals. Furthermore, in a relationship governed by public law, the freedom to perform acts is much less, as it is governed by strict legality. This means that the parties involved can only do what is provided for or authorized by law. In a public law relationship, you are only authorized to perform an act if there is a law granting you permission to do so. Examples of branches of public law include constitutional, administrative, procedural, tax, criminal, and electoral law. Legal entities under public law can be governed by domestic or foreign public law. According to Article 41 of the Civil Code, legal entities under public law are the Union, States, Municipalities, Federal District, Territories, autonomous agencies (including public associations), and other public entities created by law. The Union, States, Federal District, and Municipalities are legal entities that belong to the Direct Administration. Indirect Administration is comprised of entities that perform administrative activities in a decentralized manner. Authorities, public foundations, public companies, and mixed-capital companies are part of the Indirect Administration.
