It may even be that your residence is also your domicile, but this will not necessarily be the case. Today you will discover the differences between domicile and residence, for Civil Law. What is a residence, and what is a domicile? A residence is the place where a person lives, with a permanent intention. It is not a temporary dwelling, such as a hotel stay. A residence requires the intention of permanence. An individual may have several residences. For example, he may have several houses, in different places. According to article 70 of the Civil Code, the domicile of a natural person is the place where the person establishes his or her permanent residence. If a person has more than one place of residence (living alternately between these places), then any of these places will be considered domicile. The place where the person exercises his or her profession must also be taken into account to define the place of the person's domicile, with regard to relations related to his or her profession. The place of the profession is considered domicile for professional acts. A residence is the mere physical place where the person resides (it is the house where he or she lives). The domicile is much more important, legally speaking, because it is the place where the person can be found for legal purposes. Within the types of domicile, we have the voluntary domicile and the necessary domicile. The voluntary domicile is the one that arises from the person's will. Here, we have 2 types of voluntary domicile: the common and the special. The special domicile is the one that applies to some legal transactions. It is called the Forum of Election. The necessary domicile is the one that arises from the law. In the Civil Code, this can be seen in article 76. Those who have a necessary domicile are the incapacitated, the civil servant, the military, the seaman and the prisoner. When it comes to legal entities (public or private), the rules are very different. Enjoy the video!
