She looked fantastic on camera and the cop testified that she blew a whopping ".165" on the Preliminary Breath Test (PBT). There was no proof (in fact, on video, they said it was ".156, 157... something like that..?" Making their determination suspect since they never preserved the number on their badge cams NOR ever photographed the number on the PBT (takes 2 seconds). At one point, the officer slips up and mentions the inadmissible PBT, on accident. So, naturally, I jump on it IMMEDIATELY. I try to convince the judge we can talk about it but the number can't get in, WHICH IS THE LAW. She declines. Says "all or nothing;" so I go for broke. It pays. Jury doesn't believe the cop. Acquits my clients who looks and talks SOBER on camera. They even acquit her of the reckless driving charge because as one juror later told me "all 6 of us had gotten lost by GPS and taken down the wrong way on these streets before, so we know...."
