From December 24, 2025, regulations requiring the disclosure of salary information during the recruitment process and prohibiting asking candidates about their earnings history will come into effect in Poland. This is the first step towards implementing Directive (EU) 2023/970, which is expected to be fully implemented by June 7, 2026, and which introduces, among other things, the right to information on salaries and pay gap reporting. (Legal basis: EUR-Lex – Directive 2023/970; Polish changes regarding recruitment from December 24, 2025 are described by Infor and DGP, among others.) In this episode, a legal advisor from KZ Legal explains who will be subject to the new obligations, what information must be included in recruitment, how the employee's right to information works, and who reports the pay gap and when (employment threshold and schedule – including the first report for 2026 in June 2027, and the 150–249 and 100–149 thresholds). We also explain the reversal of the burden of proof, possible compensation and penalties, and provide a practical implementation checklist for HR and compliance.
