Decree 207/2026/ND-CP on Quality Management, Construction, and Maintenance of Works This is a very important document on quality management, construction, and maintenance of works. The Decree manages the entire lifecycle of a construction project: commencement, construction, materials, testing, supervision, acceptance, handover, warranty, maintenance, safety assessment, handling of hazardous structures, demolition, and construction incidents. 1. Key Contents The Decree focuses on the following main groups: classification of works; conditions for commencement; site management; management of materials, products, components, and equipment; testing, inspection, and monitoring; responsibilities of the investor, contractor, supervisory consultant, and designer; acceptance of work, stages, and completion; inspection of acceptance work by state agencies; project completion documentation; handover, warranty, and maintenance; safety assessment; handling of hazardous structures and structures that have reached the end of their service life; Demolition and construction incidents. 2. Clearer Responsibilities The investor is responsible for organizing quality management, construction, supervision, acceptance, and handover of the project for use. If a project management or supervision consultant is hired, the consultant is responsible according to the contract, but the investor still has to inspect and bear overall responsibility. The construction contractor is directly responsible for the quality of the work, construction safety, site management, construction methods, safety measures, testing, internal acceptance, progress, quantity, and quality documentation. The investor's acceptance does not reduce the contractor's responsibility. The main contractor is responsible to the investor for the work of the subcontractors. 3. Construction Commencement and Site Management Conditions Before commencing construction, all necessary conditions must be met, including the construction site, a building permit (if required), approved/assessed design, construction contract, construction methods, safety measures, and a commencement notice. The construction site must have signage, barriers, access control, neatly arranged materials, safety signs, fire safety signs, and a site plan. 4. Material Management, Testing, and Acceptance Materials, products, components, and equipment used in the construction must have documentation of origin, quality certificates, conformity declarations (if required), technical documents, test/inspection results, and acceptance reports before use. Materials of unknown origin, lack of factory certificates, insufficient testing, lack of conformity declarations, unauthorized changes in material types, or using materials first and then supplementing documentation later all pose significant risks during inspection, auditing, acceptance, and final settlement. Testing, inspection, and monitoring are no longer secondary procedures. Contractors must develop a testing plan, take samples under supervision, and promptly address any abnormal signs such as subsidence, cracking, tilting, landslides, or safety hazards. 5. Acceptance and Completion Documentation Acceptance includes work acceptance, phase acceptance, item acceptance, and final project acceptance, as well as inspection by state agencies regarding the acceptance process for projects subject to inspection. Construction is not a matter of completion and immediate commissioning. The project must meet acceptance requirements, have complete documentation, sufficient test and inspection results, final completion certificates, fire safety certificates (if applicable), and other necessary confirmations. The documentation is a vital set of records, including legal documents, design documents, quality management documents, as-built drawings, test results, acceptance reports, material and equipment documents, operation, maintenance, fire safety, environmental, safety, and handover documents. 6. BIM, Electronic Documentation, and Maintenance The Decree permits the application of information technology, BIM, and electronic documentation in construction management, quality control, acceptance, and handover. Electronic documentation must be accurate, truthful, secure, safely stored, and accessible upon request from competent authorities. After handover, the project must still be managed through warranty, maintenance procedures, maintenance plans, monitoring for maintenance purposes, and safety assessments. Projects that have reached the end of their service life or show signs of danger and wish to continue operating must undergo inspection, assessment, and appropriate procedures. 7. Risks to be aware of The biggest risks include: discrepancies between acceptance documents and actual conditions; materials being used in construction before acceptance; lack of a testing plan; unsupervised sampling; lack of safety measures; failure to stop construction when ...
