How do employers REALLY feel about their employees taking FMLA leave? The truth is employers HATE workers taking leave under the Family Medical Leave Act. Covered employees have a legal right to take leave under FMLA for a serious medical condition, but employers are generally not to happy about it. Actions taken at work against an employee in order to encourage the person not to exercise their right to do so is known as FMLA interference. Actions taken to discourage the employee from exercising their rights under the FMLA are unlawful, but because employers so dislike employees taking intermittent or continuous medical leave, it happens all the time. Create a written record by emailing HR of the interference actions experienced. It may resolve the situation, or the situation may escalate. It's not uncommon to then lose your job over raising the issue and standing up for what you are entitled. The matter has now escalated from interference to FMLA retaliation. Your company has taken a negative action in retaliation over your exercising of your medical leave rights under federal law. If eligible for qualifying medical leave, you are entitled to take it under the law.
