This video deals in detail with the waiver of the obligation to provide consideration under Section 326 I 1 Hs. 1 BGB, i.e. the question of what happens to the consideration if the main performance has become impossible (Section 275 I-III BGB). The focus of the video is on the four most important grounds for exclusion, under which the creditor of non-cash performance must continue to pay the purchase price despite the impossibility of fulfilling the main obligation: (1) Sole or predominant liability of the debtor, Section 326 II 1 Alt. 1 BGB; (2) Default of acceptance, Section 326 II 1 Alt. 2 BGB; (3) Transfer of risk through handover, Section 446 1 BGB; (4) Transfer of risk in the case of a sale by dispatch (send obligation), Section 447 I BGB. The last ground for exclusion specifically addresses the problem of transport by the debtor's own people (usually employees).
