Alles zur Unmöglichkeit nach § 275 I - Schuldrecht AT 08
This video deals in detail with the actual impossibility under Section 275 I of the German Civil Code (BGB). Impossibility is a very complex reason for extinction, which is why this topic is explained in particular detail here. In addition to distinguishing between objective and subjective impossibility, we will primarily look at a step-by-step scheme that can be very helpful in the expert examination of impossibility. We will then deal with exam classics such as the distinction between individual debt, generic debt, and reserve debt (so-called limited generic debt), the concretization under Section 243 II of the German Civil Code (BGB), the "quasi-concretization" under Section 300 II of the German Civil Code (BGB), absolute and relative fixed-term transactions, and other reasons that lead to impossibility, as well as some exceptions and exam pitfalls. I will then briefly address the problem of temporary impossibility. At the very end of the video, I will then examine an exam case entirely in the style of an expert opinion. -------------------------------------------- 0:00 Context and Example 1:13 Where do you examine impossibility according to Section 275 I of the German Civil Code (BGB)? 2:00 Objective and subjective impossibility 4:59 Step-by-step scheme for the impossibility test 7:56 Particular debt, generic debt, and inventory debt 14:40 Specificity, Section 243 II BGB 22:00 "Quasi-specificity," Section 300 II BGB 24:13 Absolute and relative fixed-term transactions 27:00 Loss or expiration of the purpose of the performance 27:58 "One has to have money" 28:45 P: Temporary impossibility 31:21 Example exam (written by an expert) -------------------------------------------- D O W N L O A D D A T I E S: Practice exams on Austrian Law of Obligations: 👉 (Link not yet available) All relevant definitions/formulas from Austrian Law of Obligations in one PDF: 👉 (Link not yet available) available) All relevant exam patterns from the Austrian Law of Obligations in one PDF: 👉 (Link not yet available) ------------------------------------------- MENTIONED VIDEOS: Regarding the video series "Austrian Law of Obligations for the Exam": 👉 • Schuldrecht AT für die Klausur (komplett) Delay in Acceptance, Section 293 et seq. of the German Civil Code (BGB): 👉 • Annahmeverzug bzw.
