ADHÉSION à L’UNION EUROPÉENNE 🔤

Initially composed of six states (Germany, France, Italy, the Netherlands, Belgium, and Luxembourg), the European Union quickly expanded (today it has 27 member states). Since the Maastricht Treaty (1992), any European state that respects the values ​​of Article 2 TEU and commits to promoting them can apply for membership. Under Article 49 of the TEU, candidate countries (e.g., Albania, Montenegro, Serbia, etc.) must meet three conditions: 1. Legal condition: being a state 2. Geographical condition: being a European state 3. Democratic condition: being a democratic state These are in addition to the three eligibility criteria derived from practice: 1. Political criterion: existence of a democratic state; 2. Economic criterion: capacity to ensure a viable market economy and to compete within the EU; 3. The acquis communautaire criterion – the administrative and institutional capacity of the state to implement the acquis communautaire by assuming the obligations of membership. A fourth criterion is added: 4. The integration capacity criterion, which depends on the Union itself. This refers to the EU's capacity to assimilate new members and deepen integration. To become a member, candidate states must undergo an accession procedure. Stages of the accession procedure: 1. Submission of the application for membership 2. Granting of candidate status 3. Pre-accession strategy (familiarizing the candidate with EU procedures and policies by providing financial assistance) 4. Decision by the European Council to open negotiations 5. Signing of the accession treaty 6. Accession to the EU – national ratification of the accession treaty by each of the member states and by the candidate state, whose accession becomes effective. The candidate country then becomes a member state. Membership in the European Union brings many advantages, such as the freedom for its citizens to live, study, and work anywhere in the EU, and access to the world's largest single market. However, it is important to remember that a state's integration into the European Union also entails significant obligations. The state must incorporate all primary and secondary provisions of EU law. By joining the EU, the state also agrees to share its sovereignty with the EU institutions and other member states, recognizes the primacy of the EU, and commits to respecting and implementing all existing and future EU legislation.
