You will sign an EARNEST MONEY AGREEMENT when you buy a house, a flat, or an apartment. You should know that there are penal deposits, penal deposits, and confirmatory deposits, and that if you need a mortgage to buy, it is essential that you sign the correct earnest money contract. Typically, you will be offered a penal deposit contract subject to Article 1454 of the Civil Code, which stipulates that if you ultimately fail to buy or back out, you will lose the money you paid on account, and if the seller defaults, they must return double the amount. This doesn't solve the problem of what happens if, as is most common, you don't have the money to pay for the house you bought in cash and need a mortgage to buy the home. If the bank later doesn't grant you the mortgage, you risk losing the deposit you paid on account of the home.
