A #home reservation contract is a private agreement between a buyer and a seller (or a developer/real estate agency) whereby the buyer expresses their intention to purchase a property and, in return, the seller agrees not to sell it to another person for a specified period. Key features: It is not legally binding like a final sale, but it does create commitments for both parties. A deposit or reservation fee is usually paid (typically between €500 and €3,000, depending on the property's value). The timeframe is usually short (15-30 days), during which the buyer typically arranges the mortgage or reviews the documentation. It's not the same as a deposit contract, although they are sometimes confused. What happens if one party backs out? If the buyer withdraws, they may lose the deposit. If the seller backs out, they usually have to return double the deposit (although this depends on the agreement). ➡️ What is a deposit contract? A deposit contract is a private document in which the parties agree to reserve the purchase of movable property. In this case, the buyer makes an advance payment known as a deposit, equivalent to a percentage of the property price. Subsequently, this deposit is deducted from the agreed purchase price.
