ACCIDENTE ANGROIS | La SENTENCIA absuelve al EXDIRECTOR de SEGURIDAD en la CIRCULACIÓN de ADIF

The Provincial Court of A Coruña has acquitted Andrés Cortabitarte, the former Director of Safety in Rail Traffic at Adif (Spain's railway infrastructure manager), in the case concerning the 2013 Angrois train accident, which left 80 dead and 144 injured. The decision includes a dissenting opinion from one judge, according to the ruling notified to the parties this Friday. The Court concludes that "criminal responsibility cannot be attributed" to the former Director of Safety, since "the evidence presented does not allow us to conclude that there was a specific action that the appellant was obligated to perform and that he omitted." Thus, it states that it was not demonstrated that the derailment could have been avoided with a probability approaching certainty had the assessment been carried out. "It was not proven with due certainty that his functional scope placed him in a position of specific guarantee with respect to the risk that occurred and that determined the results," the ruling notes. The court has unanimously upheld the two-year and six-month prison sentence imposed on Francisco Garzón, the driver of the Alvia train that derailed on July 24, 2013. He was found guilty of 79 counts of manslaughter and 143 counts of causing injury, all due to gross negligence. Garzón was convicted for exceeding the speed limit at which he approached the A Grandeira curve, where he should have reduced his speed from 200 to 80 kilometers per hour. Cortabitarte was convicted for failing to conduct a risk assessment that would have led to the activation of the highest safety system on that section of track, the ERTMS, which would have automatically stopped the train in the event of human error.
