The CLARITY Act may run out of time, and the problem doesn't end with the recess: upon returning, a new shutdown threat could seize control of the Senate's schedule. Today we reconstruct the dates and all the possible scenarios. The CLARITY Act is entering the most difficult countdown of its entire journey. John Thune largely controls the Senate's schedule, but he can't muster the 60 votes needed to overcome a closure or unilaterally eliminate procedural deadlines if the Democrats decide to use them. And now an additional problem has emerged that is only just beginning to be explained: if the cryptocurrency market structure bill doesn't advance before the August recess, when the senators return, they will have another major legislative battle waiting. Current funding for the US government expires on September 30, 2026. If Congress hasn't passed budget legislation or a new extension by 12:01 a.m. on October 1, the United States would again face the risk of a government shutdown. The House of Representatives has already approved an extension until December 4, but that bill still needs to pass the Senate and any political negotiations that may arise during the process. This completely changes the timeline for the CLARITY Act. Thune has said he wants, at the very least, to begin its passage and see where the votes actually stand. But beginning doesn't mean passing. Before reaching the final vote, a motion to proceed, several closing votes, subsequent debate, the introduction and approval of a substitute text, consideration of amendments, and a final vote on the entire bill may be necessary. The real question is whether the votes, procedural cooperation, and time to finalize the legislation before the recess all exist simultaneously. And if they don't, what are the real chances of crypto market regulation when the September calendar is dominated by federal funding and the threat of another government shutdown?
