Jumping the Gun
The plaintiff says he parked at a store, got out of his car, ran into a friend, and was towed by the defendant just two minutes later. He claims that when he confronted the defendant, he was told that because he had left the blacktop and was not shopping, his vehicle was subject to towing. He says there were no signs indicating such a policy and is suing for a refund, claiming the tow was illegal. The defendant says the plaintiff parked his car, left the parking lot without shopping, and therefore was subject to towing under the property’s rules. He insists the tow was justified.
