“Un abuso de la tutela”: Héctor Riveros tras decisión de juez contra De La Espriella

Through a precautionary measure stemming from a tutela action (a legal action to protect fundamental rights), candidate Abelardo de la Espriella has been ordered to remove, within 24 hours, all advertising on social media and in print media that includes the national flag, the coat of arms, or any allusion to the Armed Forces. The ruling argues that the use of sovereign symbols by a specific campaign could affect the freedom of the electorate by suggesting that opposition to the candidate equates to disloyalty to the nation. However, the measure has sparked profound criticism regarding its legality and technical feasibility. Analysts and legal experts warn that the tutela mechanism is being used improperly to resolve matters that fall under the jurisdiction of the National Electoral Council, the body that had already authorized De la Espriella's campaign logo, deeming it did not cause confusion with state emblems. The inability to remove billboards and banners within the stipulated time, coupled with the difficulty of modifying the ballots that already include the disputed symbols, creates a scenario of legal uncertainty in the final stretch of the electoral process.
