Punitive action will be taken if abnormal rates are given in the tender. Recently, it has been observed that some bidders are submitting bids at excessively low or nominal prices against the bids invited by the Procuring Entity. In some cases, abnormally low bids (e.g. 50%, 60%, 90% and even up to 99%) are being submitted compared to the official estimated cost. Such bids are clearly unrealistic and unacceptable in the context of a cost estimate made rationally in the normal market concept. In the context of the coming into force of PPR, 2025, it appears from the review of several incidents requested by the buyers that some bidders are colluding with each other to make a particular bidder successful by influencing the tender evaluation process. As a result of such a trend, on the one hand, the chances of real and realistic bidders getting the work are decreasing, on the other hand, the execution of contracts at excessively low prices in government procurement is creating risks in the implementation of the work. Above all, it is included in the 'conspiratorial acts' described in Rule 149 of the PPR, 2025, which is tantamount to professional misconduct. 02. It is to be noted that the provisions of Rule 42 (2) and (3) of PPR, 2025 regarding attempts to unfairly influence any tender process and the measures to be taken in this regard are as follows: "42. Obstacles and prohibitions on disclosure of information related to the procurement process, etc.- (2) The tenderer or applicant shall not in any way attempt to influence the examination and evaluation process of the application, tender, expression of interest or proposals. (3) If any tenderer or applicant attempts to influence the decision of the purchaser regarding the evaluation of the tender, quotation, application, expression of interest or proposal or the award of the contract, the tenderer or applicant may take action under Section 64 (5) of the Act by cancelling the tender, application or proposal of the said tenderer or applicant." 03. It is noteworthy that in the past, in the context of the significant decrease in the level of competition in government procurement due to the application of 10% price capping in internal procurement as per PPR, 2008, the provision related to price capping in tender evaluation was abolished based on the opinions of the concerned stakeholders. As a result, in PPR, 2025, the acceptability of tenders with significantly low price is being determined by following the process mentioned in Schedule 18. This is an adaptation of internationally recognized good practice. As a result, after the implementation of PPR, 2025, it is being observed that competition in government procurement has increased significantly. 04. In the above circumstances, if any tender price is submitted in a government tender at a price significantly lower than the official estimated cost, if the said price/prices appear to the Tender Evaluation Committee to be unrealistic and given with a motive, then it is appropriate to consider it as an attempt to influence the tender evaluation process in light of the instructions mentioned in Rule 42(2) of PPR, 2025. It is advisable to consider such an act as a 'conspiratorial act' as per Rule 149(2) (c) of PPR, 2025 and take appropriate action against the tenderers by necessarily complying with the relevant sub-rules of Rule 149. 05.
