PENALTY IN A PROBATIONARY CONTRACT In this video, I explain everything you need to know about penalties in a probationary contract. There are two possible penalties in a probationary contract: the first is governed by article 479 of the CLT (Brazilian Labor Law), and the second is governed by article 480 of the CLT. In the case of the penalty under article 479 of the CLT, this is in favor of the employee. If the company decides to terminate the probationary contract before its agreed-upon term, it will have to pay a penalty equal to half the number of days remaining until the end of the probationary period. In the case of the fine stipulated in Article 480 of the CLT (Brazilian Labor Law), this is in favor of the company. If the employee decides not to fulfill the stipulated period in the probationary contract by resigning during that period, there is the possibility of a fine being applied to the probationary contract. In this case, the company will also have the right to deduct half the value of the remaining days at the time of termination, but to do so it will need to prove that it suffered some loss due to the resignation and non-fulfillment of the probationary contract.
