20-Year-Old Girl Arrested for DUI in Front of Fraternity House

On December 1, 2023 at approximately 10:41 PM, Officer Jared Aubertin with the Pullman Police Department observed a 2011 Subaru Legacy fail to stop at a stop sign on NE B Street. Officer Aubertin activated his emergency lights to initiate a traffic stop, and the vehicle pulled stopped in front of the Sigma Chi fraternity house on NE California Street. After he stopped the driver, He proceeded to make contact with the driver, who was identified as 20-year-old Faith. After he asked for assistance, Officer Mike Leggett arrived on scene shortly afterwards. After Officer Aubertin made contact with Faith, he detected the odor of a prohibited substance in the vehicle and noticed that she was displaying indicators of impairment. Officer Leggett approached the vehicle next and began his DUI investigation. Based on his suspicion of impairment, Officer Leggett asked Faith to exit the vehicle and offered her an opportunity to participate in field sobriety exercises. Faith exited the vehicle and agreed to perform field sobriety exercises. The first field sobriety exercise was the horizontal gaze nystagmus (HGN) test, and he observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second field sobriety test was the Walk and Turn test. During the Walk and Turn test, Faith took a total of 14 steps forward instead of the 9 steps she was instructed to take and failed to touch heel-to-toe on each step. The final field sobriety exercise was the One Leg Stand test. During the One Leg Stand test, Faith failed to raise her foot in the proper fashion, put her foot down after approximately 10 seconds, and displayed a lack of balance. After the field sobriety exercises were complete, Officer Leggett asked Faith if she would be willing to take a preliminary breath test (PBT), but she declined to do so. Based on his suspicion of impairment, her inability to adequately perform the field sobriety exercises, and her refusal to take a PBT, Officer Leggett placed Faith under arrest for driving under the influence. Faith was placed in the patrol car and transported to the Pullman Police Department for further processing. Once they were at police HQ, Officer Leggett read Faith her Miranda rights as well as the Implied Consent Warning, and she agreed to submit breath samples for testing. He began the 20-minute observation period, and Faith admitted to consuming alcohol in the hours prior. After the breathalyzer was administered, her Alcotest results indicated a BAC of 0.216% (lowest IR result). After Officer Leggett was finished with administering the breathalyzer, he placed Faith in a cell. After a brief holding period, Faith was removed from the cell to be photographed and fingerprinted. After spending some more time in the cell, her belongings were returned to her and she was released with a summons to appear in court.
