Amendments to the Labor Standards Act That Home Care Agencies and Care Workers Must Know! Previously, there was a problem in home care services where a 30-minute break had to be granted due to the Labor Standards Act, even after providing 4 hours of service to elderly individuals classified as Grade 1 or 2. In reality, there were instances where caregivers had to stay at the elderly person's home for an additional 30 minutes even after the service had ended, leading to long-standing criticism from the field that this was unreasonable. With the recent amendment to Article 54 of the Labor Standards Act, an exception has been newly established allowing for the non-granting of a break during a 4-hour workday if the worker explicitly requests not to use the break time. However, contrary to the misconception many people have, this does not mean that all break times will be eliminated. This amendment applies only to exceptions where the working time is exactly 4 hours, and an explicit request from the worker is mandatory.
