A new legal battle has emerged in the high-profile treason case involving Dr. Kizza Besigye and Hajji Obeid Lutale. The two have asked the High Court to declare that their constitutional rights were violated after their lead lawyer, Martha Karua, was denied entry into Uganda and deported back to Kenya. They argue that the move was intended to weaken their defence and deny them the right to legal representation of their choice. In the application, Gen. Muhoozi Kainerugaba and the Attorney General are named as respondents. Besigye and Lutale also accuse the CDF of making public statements that prejudged the case and interfered with the independence of the judiciary. They further argue that the prosecution of their lawyer, Erias Lukwago, is part of a broader campaign to intimidate members of their legal team. The application asks the court to overturn the decision declaring Karua a prohibited immigrant, permanently allow her to represent them in Uganda, halt proceedings against Lukwago that they say are linked to his legal representation, and award damages for what they describe as violations of their constitutional rights. The case stems from events dating back to November 2024, when Besigye and Lutale were arrested in Nairobi before being brought to Uganda to face treason charges. Prosecutors allege they participated in meetings aimed at overthrowing the government, accusations they have consistently denied. The High Court has not yet fixed a hearing date, and Gen. Muhoozi Kainerugaba and the Attorney General are yet to file their responses.
