Canada’s Legal Fight Over Indigenous Land
A landmark court ruling that recognized Indigenous rights over some 800 acres of metro Vancouver has triggered political upheaval across Canada. Last year, the Supreme Court of British Columbia recognized the Cowichan people’s aboriginal title over a slice of Richmond, just south of the city of Vancouver. Various parties, including the federal government and First Nations, must now reconcile Indigenous title with the rights of private owners. In the meantime, the case has been challenged by every party and further appeals could take years. The situation has become a lightning rod in the debate about Canada’s colonial history and Indigenous land rights. As conservatives sought to capitalize on the controversy, Prime Minister Mark Carney told the House of Commons the government “fundamentally disagrees” with the judgment and will always protect private property.
