[L130] HOW TO WIN A CCMA CASE FOR UNFAIR DISMISSAL & CON/ARB EXPLAINED BY EMPLOYMENT LAW ATTORNEY
This video explains how to prepare for a CCMA case for unfair dismissal in South Africa. There are various stages that the case goes through. The first stage is generally Conciliation. If the case is not settled or resolved, then the case goes to Arbitration. The CCMA will then appoint a Commissioner who will hear both sides of the case and then make an award regarding whether the dismissal was done in accordance with the Labor Relations Act. According to South African Law, the employer must show that the trust relationship is broken down and must have a fair reason for the dismissal. If not, then the employee can claim for compensation. What is con/arb process at the CCMA? This is a faster process which combines the conciliation and arbitration process into one hearing. They are usually held immediately after each other. If conciliation fails, the case immediately gets referred for arbitration. When do you take your witnesses to the CCMA? Only at Arbitration will your witnesses be heard. The employer will generally start first in terms of section 192 of the Labour Relations Act. How to get evidence for CCMA Arbitration?
