The Supreme Court, in the matter of M/s Chopra Hotel Private Limited v. Harbinder Singh Sekhon, SLP (C) Nos. 9321–9322 of 2026, witnessed intense and vigorous arguments between senior advocates representing the respective parties. The matter has been reserved for orders, which are scheduled to be pronounced on 08.04.2026. Senior Advocate Dr. A.M. Singhvi appeared on behalf of the petitioner, M/s Chopra Hotel Pvt. Ltd., while Senior Advocate Balbir Singh represented the respondent, who is also the petitioner in the underlying Public Interest Litigation (PIL). Counsel for the State as well as the Municipal Corporation, Jalandhar, were also present and advanced their submissions. The dispute revolves around allegations of illegal and unauthorized construction carried out in the hotel premises dating back to the year 2011. It was submitted that a demolition notice had been issued to the petitioner, directing them to undertake demolition of the unauthorized structures. However, instead of complying, the petitioner initiated multiple legal proceedings challenging the action. During the course of arguments, it was highlighted that various courts had consistently held the construction to be illegal. Additionally, issues were raised regarding the alleged conversion of the property usage from a hotel to commercial purposes, further aggravating the violations. A key contention raised was that despite clear findings of illegality, the petitioner continued to seek protection under interim orders, including a stay granted in writ proceedings. The Bench was urged to consider whether such protection could be sustained in light of the repeated judicial findings. The Court also took note of submissions made by the State’s counsel, who clarified that no further construction activity would take place at the site in question. After hearing all parties at length, the Supreme Court reserved its judgment in the matter.
