This amendment includes a provision for "special exceptions for statistical compilation, etc.," creating a new system that allows companies, the national government, and local authorities to acquire and use extremely sensitive personal information, such as medical history, mental illness, and genetic information, without the individual's consent. The government itself has acknowledged that this exception applies to mobile phone location data, epidemiological survey data on COVID-19, and even data used by companies for AI development purposes. There are serious concerns that this could effectively become a loophole for virtually unlimited collection of personal information. Furthermore, I pointed out that this could create a "pipeline" that circumvents the confidentiality obligations that doctors, pharmacists, etc., have under Article 134 of the Penal Code, potentially undermining the trust relationship between patients and doctors. Furthermore, despite the existence of injunction systems and strict penalty systems in the EU and G7 countries, these are not included in the current amendment. We questioned the minister about why the injunction system, which the Personal Information Protection Commission deemed necessary, was omitted. Particularly serious is the fact that Prime Minister Takaichi, who is responsible for introducing the bill, stated that she had "not received an explanation" regarding such a serious concern. If the bill was approved by the Cabinet and submitted to the Diet without the Prime Minister recognizing the risks, the legitimacy of the bill's submission process itself is called into question. We strongly urged the government to revise and clarify the following four points: ① Legal obligation to remove identifiers from sensitive personal information ② Legislation of an injunction system in the next Diet session ③ Ensuring prior reporting to the Diet and opportunities for review when establishing committee rules ④ Guaranteeing a level of protection equivalent to that of the Next-Generation Medical Infrastructure Act and to withdraw and resubmit the bill. Data utilization and human rights protection can coexist.
