Royce Clayton's Entire Cross-Exam In Iskander Boys' Wrongful Death Lawsuit Trial
Scott Erickson's lawyer Jeff Braun began his cross-examination of Erickson's friend Royce Clayton about their 30-year relationship, which began in Major League Baseball. "How was your relationship with him before this incident happened?" Braun asked. "It was good," Clayton answered. "I mean, did you guys consider to be close friends?" Braun asked. "I mean, that's depending on how you consider, what you consider a close friend. I've known him for over 30 years," Clayton answered. Clayton, Erickson and Erickson's girlfriend, Rebecca Grossman, left a restaurant in Westlake Village, California, about 7 p.m. on Sept. 29, 2020, planning to meet again at Grossman's home to eat tacos and watch the presidential debate. Clayton went to a grocery store and didn't witness Grossman strike Mark Iskander, 11, and Jacob Iskander, 8, while she and Erickson were speeding alongside each other in their Mercedes-Benz SUVs. He testified he contacted his cousin, a former sheriff's deputy, when he learned after Grossman's arrest that police were looking for another driver, who he knew was Erickson. In cross-exam, Braun tried to discredit Clayton's testimony that Erickson told he and Grossman were speeding. 03:33 "Back in covid times Julio had a makeshift patio that they put in the parking lot so that they can serve patrons. Would you agree with me?" "Yes." "And so generally, this would have been the area that you Scott and Ms. Grossman had sat in on the night in question?" "Yes." 06:35 "You would agree, based on your history with Mr. Erickson of having drank alcohol with him that he was not impaired. When he left, whose —" Judge Huey Cotton sustains a foundational objection "Did you develop an impression on whether or not he was impaired?" "It never came to my mind that he was impaired." "So as you're leaving that night, you had no concern about his ability to operate a vehicle, did you?" "No." "He was not drunk, was he?" "No." 07:28 "Like you said, I've known him for 30 years, and if from his stature and I had no concern of what I saw him consume that day without him being impaired, no." 10:20 "There are a number of calls until he told me that he was on the side of the road in the bush. I had no idea where he was." 12:29 "And what what he told you he was standing off the side of the road, watching what was happening?" "Yes." "Would you agree that he never mentioned anything to you about hiding at the scene, being in a bush behind a tree, anything like that?" "No, he told me he was in a bush watching what happened." 14:37 deposition testimony: " question and how do you know that Mr. Erickson did not identify himself to the police when he went back to the accident scene. Answer, because he said he was standing like standing off to the side watching. Question, did he indicate to you that he was standing behind trees or shrubs or something like that? Answer, I don't recall." 19:17 "I can clarify this in a very simple explanation, sir. So if I'm talking to you, and we're friends, or, you know, we know each other, and you you don't use the rare racing, because nobody's gonna say that, I'm fine. We're fucking flying down the street. How about that?" "Did he say we're fucking flying down the street?" "Yes." "That's the exact words you recall I'm saying." "Yeah. Now that you bring it to my memory, it doesn't matter." 24:33 "When, when you testify that, Mr. Erickson, saw Ms. Grossman hit the kids. Are you assuming that, or, to your knowledge, that he gave that information after seeing her vehicle at the scene?" "Can you restate that?" "Yeah, I'm trying to figure out you said. You said that he he told you he saw or hit the kids. Did he actually tell you he saw that?" 32:54 "You told Deputy ... that when you called Mr. Erickson for the address, he told you there had been a horrible accident, correct?" 36:50 "I never told him that. Scott didn't tell me, Mr. Erickson, didn't tell me any details about the accident." 37:26 "This is totally inaccurate of my conversation with any deputy containing what matters, why I call the sheriff's department. Totally inaccurate." 44:35 "Did you ever tell either detective that you learned that Mr. Erickson and Ms. Grossman were racing?" "When I called the sheriff's department had that conversation, I explained to them exactly what Scott Erickson explained to me and how these young people perished." 48:14 "Did Mr. Erickson ever say anything to you about threatening Miss Grossman's daughter?" "No." 56:18 cross by Grossmans' lawyer Esther Holm
