Litein Parents Sell Cows and Tea to Pay Sh25,000 Fine Imposed by School

Lawyers Danstan Omari and Shadrack Wambui of Sheria Mtaani secured a crucial court victory on behalf of parents and students of Litein Boys High School. Justice Sargon of the Kericho High Court ordered the school to readmit Form Four students who had been sent home over a KSh 49,000 fee demand. The court directed that each student be allowed back upon paying only KSh 10,000, enabling more than 800 candidates to sit for their national examinations beginning October 22, 2025. The advocates argued that the school’s directive was oppressive and unconstitutional, especially amid the harsh economic climate. Omari hailed the ruling as a “landmark decision” affirming that education is a fundamental right under Article 53 of Kenya’s Constitution, protecting learners from unfair administrative actions by school management.
