Isolamento del detenuto

A new mini podcast from the series "The Court's rulings in 3 minutes" is available, dedicated to ruling number 31 of 2026 (press release of 17 March 2026), with which the Constitutional Court declared inadmissible the questions raised by the Court of Florence with respect to Articles 33, 39 and 40 of Law number 354 of 1975, relating to the isolation of prisoners subjected to the disciplinary sanction of exclusion from common activities. These provisions were criticised by the referring court for lack of proportionality, contrary to the re-educational purpose of the sentence, damage to the psychophysical health of the person and failure to comply with the legal and jurisdictional reserves regarding restrictions on freedom of communication.
