And what are they? Today I'm here to explain this important topic of Constitutional Law! Impermanent clauses are a set of matters that cannot be removed from the Constitution. A constitutional amendment cannot remove these contents from the Constitution. They can be expanded, but they cannot be reduced. To change the content of impermanent clauses, a new Constitution must be enacted. Our Constitution contains four impermanent clauses, which are listed in Article 60, §4: 1) Federative form of state: refers to the model of the Brazilian State, which is that of a federated state, not a unitary or confederated state. A federation is the union of several autonomous states. Not sovereign, but autonomous. Autonomy means that the states have the capacity for self-organization. However, only the Federative Republic of Brazil is sovereign. The fact that the federative form of state is an impermanent clause means that constitutional amendments that excessively reduce the autonomy of the states are prohibited. Furthermore, secession is prohibited, meaning a state cannot simply declare its desire to separate from the rest of the country. 2) Direct, secret, universal, and periodic voting: Direct voting means voting without intermediaries, but there is an exception established in the constitution itself, which is a situation in which indirect voting is permitted, such as in the case of a double vacancy for the office of president of the republic in the last two years of the term. Voting is also secret, meaning confidential, universal, meaning everyone has the right to vote, as long as they meet the requirements. It is also periodic, meaning we hold elections from time to time. 3) Separation of powers: The Executive, Legislative, and Judiciary branches are both independent and harmonious. They are independent and harmonious. The person who envisioned the separation of powers as we have it today was the Enlightenment philosopher Montesquieu. The separation of powers would be a way to decentralize power and prevent abuse, as one branch of government cannot override others, and, at the same time, one branch can exercise control over others in ways that are abusive. This is called a mechanism of checks and balances, and it serves to ensure independence and harmony between the branches of government. 4) Individual rights and guarantees: Here we have Article 5 of the Constitution, which is famous for establishing individual rights and guarantees, but other articles of the Constitution, not just Article 5, are also considered to be immutable clauses, and in this case, we call them implicit immutable clauses.
