LAPSE OF AN OFFER / TERMINATION OF AN OFFER.1. BY LAPSE OF TIME: Section -6(2) By lapse of time . A. IF TIME IS SPECIFIED then After the end of the specified time an offer will be lapsed. A standing offer as it is open for a particular period of time. After the end of that time an offer will be lapsed. Example: Discount offers in a shopping malls. 1. BY LAPSE OF TIME: B. IF TIME IS NOT SPECIFIED then after reasonable time an offer will be lapsed. Reasonable time means if time is not given then need to accept it within in a reasonable time. Reasonable time will be decided by the court as it will be different for all the cases. 2 . COUNTER OFFER : Section-5 : If a counter offer is made. Counter offer means offer in response to an offer. When we are making a counter against the offer given. Example : bargaining at the shop while purchasing any product, let’s assume it’s a mobile and the shopkeeper said 13k cost and you said 12k . This is a counter offer where the old offer will get lapse. 3 . CROSS OFFER : Cross offer means making an identical offers knowledge without each other’s opinion. Example : 1.suresh writes a letter to kiran stating that he wants to sell his house. 2. Kiran writes a letter to suresh that he ants buy his house. Without the knowledge of each other making same offers. This is called as making identical offers. So suresh sends an acceptance letter to kiran this was a 2nd offer . So the 1st offer gets lapse. One contract becomes valid and the other becomes invalid. the old offer will get lapse. 4.REVOCATION OF AN OFFER Section-6(1) By communication of notice of Revocation before the acceptance is complete. An offer can be revoked at any time before it is accepted by the offeree that, it may be revoked at any time before the communication of the acceptance is completed as against the offeror and not afterwards, before the letter of acceptance is posted. 5. REJECTION OF AN OFFER: An offer will get lapse when the offeree rejects the offer of the offeror. Example : one person offered (offeror) that he will sell his car to him (offeree). The offeree instead of accepting the offer given he will reject the offer. This is rejection of an offer, where the offer will be lapsed/ terminated. 6. By not fulfillment of a condition. Section-6 (3) By not fulfillment of a condition. An offer will be lapsed/ terminated when the condition given is not full filled by the offeree. Example: when the offeror, let’s assume he is a house owner and he wants to give his house for rent only to senior citizens. If the offeree accepts this condition and he starts living in that house instead of his grandparents or his parents then the offer will be lapsed / terminated as the condition which was given is not full filled. 7. IN CASE OF THE DEATH/ INSAINITY OF THE OFFEROR OR OFFEREE. If any one of the party becomes insane/ expires then how the offer gets lapse. In case of the death of the offeree: As in the agreement or in the contract there should be the acceptance by the offeree and if the offeree expires or becomes insane then the offer will be lapse/ terminated . Agreement or contract will become void. 7. By death or insanity of the offeror. Section- 6(4) By death or insanity of the offeror. This will not apply where the personal skills are involved. Example: if x is a doctor and y is a patient as there was an agreement between them as y wants to undergo surgery by only X. if x expires then the legal heir of x cannot do that surgery as the personal skills may differ from person to person. 7. In case of the death of the offeror. If the offeror(‘x’) dies after making an agreement with offeree(‘y’) to sale his car . If y knows about the demise/insanity of x through a letter. If y, Still he accepts the offer then the In case of the death of the offeror. If the offeror(‘x’) dies after making an agreement with offeree(‘y’) to sale his car . If y doesn’t knows about the demise/insanity of x and y accepts the offer then the contract is a valid contract as the offer will not lapse and the fulfillment of the contract will be done by the legal heirs/ legal representatives of the x. 8.BY THE MODE PRESCRIBED: If there is mode/ way is mentioned in which we need to accept an offer. We have to accept it in that mode only. Section 7 (2) : If an offer is not accepted according to prescribed mode or usual mode 1.Where the mode is given. Offer will be lapse if not accepted in the mode prescribed.
