Munich, 2004. Three men, Piotr Pytel, Tomasz W. (Lis), and "Z," plan to rob a well-known prostitute, Ecaterina I. Lis allegedly entered the woman's apartment, while Pytel stood watch. The situation spiraled out of control, and the woman was killed. A police investigation led to Piotr Pytel, whose phone was on near the crime scene. From the beginning, the man told investigators that he did not enter Ecaterina's apartment and did not participate in the robbery. He only learned of the woman's death from the media. He referred to Tomasz Lis as the perpetrator, but no one listened. Aside from the testimony of fellow inmate Paulo Lufingo, who claimed that Pytel had confessed to visiting the prostitute's apartment, and the phone logs, the prosecutor's office had no other evidence to confirm that the suspect was in Ecaterina's apartment. A circumstantial trial was held. Despite this, the maximum sentence, life imprisonment, was imposed. The German side is responsible for Piotr Pytel serving his sentence in Poland since 2009. Already in 2013, the Polish prosecutor's office informed the German prosecutor's office that there were serious doubts about the convicted man's guilt and suggested reopening the proceedings. The case remains trapped between two legal systems. Polish courts cannot overturn the German court's verdict. Meanwhile, Tomasz Lis was arrested and confessed to the murder of a prostitute. In 2011, a German court sentenced him to 9 years and 6 months in prison. Today, he is a free man. However, this has not changed Piotr Pytel's legal situation. "Dear President, I would like to ask you just one question: why, contrary to the decisions of both the District and Appeal Courts, you sentenced me to the death penalty. (...)" Andrzej Duda refused to grant Piotr Pytel clemency three times, even though the Appellate and District Courts approved the clemency applications. President Karol Nawrocki's fourth attempt to pardon Mr. Piotr is his only chance for freedom. The application has already been submitted to the Presidential Chancellery.
