Is a law Islamic just because it does not contradict Sharia? Or must we ask a deeper question: where did the law come from? In this episode, Professor Dr. Muhammad Al-Massari explains a crucial distinction: some rules create obligations, prohibitions, permissions, invalidity, or legal consequences. These are legislative rulings, and in an Islamic framework they must be derived from revelation. Other rules simply organize implementation: records, forms, procedures, public administration, traffic systems, registers, and enforcement methods. The problem is not that a state has laws, regulations, or procedures. The problem begins when a substantive legal ruling comes from reason, utility, political authority, or borrowed legal systems, and is then defended by saying: “it does not contradict Sharia.” The episode moves through practical examples: zakat collection, public roads, driving permits, removing harm from pathways, corporate law, and criminal responsibility for minors. Each example shows the difference between implementing a ruling and creating one.
