He considered any deviation from the law for the sake of compromise a sin. The Path to Peace (Aaron): The opposite, but ultimately prevailing, position is taken by Rabbi Yehoshua ben Korcha. He argues that compromise is a mitzvah. He justifies this by citing the words of the prophet Zechariah: "Judge true judgment and peace within your gates." Rabbi Yehoshua emphasizes that the ideal judgment is one that leads to peace. Commenting on this dispute, the sages connect it with the role of Aaron, the High Priest and Moses' brother. He was renowned for being "a lover of peace and a seeker of peace," reconciling warring parties before their dispute reached court. Moses, on the other hand, was the supreme judge, whose task was to render a strict, unconditional verdict. Thus, the Talmud suggests not choosing one over the other, but rather understanding: there is a time for judgment and a time for peace. 🤝 How does this work in practice? While encouraging compromise, Judaism imposes strict ethical restrictions on it, lest it become an instrument of injustice. 1. Compromise. Extortion: Compromise must be voluntary and honest. It is strictly forbidden to delay a trial in order to pressure an opponent into agreeing to an unfavorable deal. Anyone who does so is obligated to return the ill-gotten gains. 2. The Role of the Judge: Ideally, the judge should first attempt to reconcile the parties. Only if compromise is impossible will they proceed to strict legal proceedings. 🧠 A Modern Psychology Perspective Relationship Preservation: Research shows that adversarial systems (courts) often destroy long-term relationships (especially between neighbors, partners, or relatives) by creating a "winner-loser" mentality. Compromise, in contrast, aims to find a mutually beneficial solution and preserve future relationships. Stress Reduction and Post-Traumatic Growth: Participation in litigation is one of the most powerful psychological stressors. Compromise gives the parties a sense of control over the situation and its outcome, which reduces stress, hostility, and the desire for revenge. Reconciliation often allows both parties to recover more quickly. Economic Rationality vs. Human Factors: Strict legal proceedings are expensive, time-consuming, and unpredictable. Compromise is often faster and cheaper.
