Lawyer Elio Riera and former Foreign Minister Javier González-Olaechea analyzed the United Nations working group's statement on the detention of Pedro Castillo and agreed that the document is not binding on the Peruvian state. As is already known, a United Nations body of experts concluded that the detention of former President Pedro Castillo was arbitrary. The document recommends that the Peruvian state order his immediate release, provide him with reparations, and investigate the irregularities detected. In an interview with Milagros Leiva, Riera maintained that the report should be understood as an opinion and not as a binding decision. "This report is non-binding; it could be considered an advisory opinion, but in no way does it create any kind of obligation with respect to the Peruvian state," he stated. The lawyer questioned the attempt to use this statement to demand the immediate release of the former president. Riera also rejected the argument that Pedro Castillo's message of December 7 was merely a political statement. According to the lawyer, the then-president used his presidential office to address the nation with legal implications for the State. “Mr. Pedro Castillo used his presidential office to address the nation with a message that would have legal consequences for the Peruvian State,” he stated. He maintained that there had been a constitutional breach and that the arrest occurred while Castillo was caught in the act of committing a crime. The lawyer added that the accusation against Castillo is not based solely on the effective closure of Congress, but also on the charge of conspiracy to undermine the constitutional order. “The message was clearly intended to break the constitutional order,” he indicated. Meanwhile, the former president received several visitors at the Barbadillo prison after the UN working group's statement was released. Among those present were Luis Bazalar, who presented himself as Pedro Castillo's spiritual advisor, as well as lawyer Carlos Torres Caro and former prosecutor José Domingo Pérez. The latter urged the Peruvian State to follow the recommendations of the international body. “What the Peruvian State must do is follow the recommendations, opinions, and requests of the United Nations,” he stated. GONZÁLEZ-OLAECHEA: “IT’S NOT A RULING, IT’S AN OPINION” Former Foreign Minister Javier González-Olaechea emphasized that the statement does not constitute an international ruling, but rather an opinion issued by a working group. “The working group issues an opinion; it’s not a ruling,” he clarified. He also maintained that this commission has a political composition and that its pronouncements are not legally binding on the Peruvian State. According to the former Foreign Minister, the document omits key constitutional aspects regarding Castillo’s detention. González-Olaechea also warned that a potential decision by President José María Balcázar to release Castillo could not be based solely on this international opinion. Riera concurred and pointed out that a pardon would have to meet previously established legal requirements. “It would be guiding the possibility of granting a pardon based on an advisory opinion that has no binding effect,” he explained.
