The Defense Refuses a Compromise Verdict for Rick Chow, Murder or Walk Free | Pt 19

The evidence is in, and the defense just made a bet that decides everything for Rick Chow. It is the Rick Chow Murder Trial, and the middle ground is gone. Rick Chow is the Columbia gas station owner charged with murder for shooting 14-year-old Cyrus Carmack-Belton in the back, after he and his son Andy chased the boy from their store. The state says the Chows were the aggressors who chased down a fleeing kid. The defense says the boy pulled a gun and a father fired to save his son. This part is not testimony. It is the charge conference, the moment after both sides rest when the lawyers and the judge decide exactly what the jury will be told before they decide Rick's fate. Two decisions here change everything. Rick decided not to take the stand, so the jury will not hear him testify or answer the state's questions. And the defense told the judge it does not want the jury given any lesser charge, which leaves no compromise verdict, only murder or a full acquittal. Then watch the fight over the instructions themselves, because the rules the judge settles on come straight from the heart of this trial, who has to prove what, and whether a man who chases someone can still call it self-defense. --- WATCH WITH JUSTICE 0:09 to 3:48 - The judge turns to Rick Chow and asks if he will take the stand in his own defense. His answer is no, and with that the defense rests. The question the whole trial has been building toward is settled, and Rick will never tell the jury his story under oath. 3:48 to 9:15 - The jury goes home for the weekend while the lawyers stay to fight over the law. Watch the defense immediately renew its motion to throw the case out before it ever reaches a closing argument. 9:15 to 10:19 - The biggest decision of the day. The defense tells the judge it does not want the jury given any lesser charge to fall back on. No middle ground, murder or acquittal, and the defense is betting everything that the jury will not convict. 10:19 to 15:05 - Watch what the judge does to the self-defense instruction. He throws out the old version because it left out the most important words in this case, that the burden is on the state to disprove self-defense, not on Rick to prove it. 15:05 to 18:36 - The defense keeps building the floor under Rick's claim, pushing for a rule that a man does not have to wait for someone to aim or fire before he acts to protect his son. 18:36 to 22:31 - The fight that is this whole case in miniature. The defense wants the jury told a shopkeeper can reasonably detain, and that reasonable pursuit comes with it. The state objects that it has no place here and that no one ever intended to detain anyone. What the state calls a chase, the defense calls following, and the verdict may turn on that one word. 22:31 to end - The last fight, over Rick's silence. The defense strips a line that made the right to stay silent sound like hiding something, leaving the jury with the rule that matters, that they cannot hold it against Rick that he never took the stand. --- READ THE FULL ANALYSIS The full background on this case, how it started and how it reached trial, is here: https://www.justiceisaprocess.com/sc-...
