Of interest is the Civil Cassation ruling No. 27531 of October 15, 2025, which confirmed the textual nullity or formal nullity of the certificate of cadastral conformity, which must be provided in deeds of real estate transfer between living persons regarding cadastral data, titles, and plans. HOWEVER, this does not apply to all cadastral discrepancies with respect to the actual state of the premises, but only to those of a minor nature and "cadastral irrelevant," i.e., not affecting the cadastral income. In other words, the Cassation Court identifies the criterion of "cadastral tolerance" as the dividing line, clearly highlighted by the cadastral legislation itself and by Circulars No. 2/2010 and No. 3/2010 of the Land Registry Agency (now the Revenue Agency). Ruling No. 27531/2025 of the Court of Cassation makes a reasoning consistent with that of the legislation, namely the current Article 29, paragraph 1-bis, of Law 52/1985: "In essence, the conformity or otherwise of the cadastral data and cadastral plans with the actual state must (and this is the meaning that must be attributed to the aforementioned clause) be assessed in light of the provisions in force on cadastral matters, relating to the discrepancies that make it mandatory to proceed with the cadastral update. Specifically, Articles 17 and 20 of Royal Decree No. 652/1939 as well as Article 19, ninth paragraph, of Legislative Decree No. 78/2010, it is inferred that even the most minor discrepancies do not compromise compliance with the current state of the property and that, therefore, such compliance must be excluded only in the presence of variations that affect the state, consistency, category and class assignment, i.e., the situations on which the cadastral income depends.
