Bound by the Law: Our Struggle with SAPS and a Local Disturbed Man
Despite numerous attempts to secure our community, our hands are legally tied. We want to make it explicitly clear that we have reported this individual to the South African Police Service (SAPS) many times. Regrettably, we are not receiving any help or proactive intervention from them at this stage. As a private security company, we must operate strictly within the boundaries of the law. Under South African legislation, we cannot lawfully arrest or forcefully remove this homeless, disturbed man until he commits, attempts to commit, or we have a reasonable belief that he has committed a Schedule 1 offence. The Hard Reality: Sadly, until an actual offence is committed, this individual is here to stay. We cannot act on potential threats alone, only on unlawful actions. We will continue to monitor the situation closely to ensure the safety of our clients within the limits of our legal powers.
