Anthropic, the Artificial Intelligence (AI) company behind the Claude app, will have to pay $1.5 billion to a group of authors and publishers in the largest copyright infringement settlement in U.S. history. The case stems from a class-action lawsuit filed in August 2024: a group of writers accused the company of using their books, without authorization, to train its AI models. The claim was broad, but a federal judge ultimately divided the matter into two parts. On one hand, he ruled that training an AI with legally acquired books—purchased and then digitized by the company itself—can be considered legitimate use, what in U.S. law is called "fair use." His argument was that this training is a "transformative" use: the AI does not reproduce or replace those books, but rather learns from them to generate different texts, something the judge compared to what anyone does when they read extensively in order to write. On the other hand, it was found that Anthropic had downloaded nearly seven million books from pirate libraries, such as Library Genesis, to build its own library, and that this was not protected in the same way. It was because of this second aspect—the piracy, not the training itself—that Anthropic ended up agreeing to pay about $3,000 for each of the approximately 500,000 pirated books identified in the case. This week, a judge gave final approval to the settlement. It's a ruling that several authors receive with mixed feelings: they receive a historic compensation, but the underlying principle—that an artificial intelligence can be trained with copyrighted works without permission, as long as they were obtained legally—remains valid.
