The court ordered the dismissal of an officer of the Air Force of the Armed Forces of Ukraine, who is raising three children and conscientiously paying alimony. The Vinnytsia District Administrative Court declared the refusal to dismiss illegal and ordered the command to adopt an appropriate decision. In case No. 120/14460/25, the serviceman proved the presence of three minor children and the absence of alimony arrears. The court concluded that such circumstances confirm the right to dismissal in accordance with the Law of Ukraine “On Military Duty and Military Service”. The key question was: is a person considered to be supporting children if they live separately, but alimony is paid properly. The court answered positively. The command refused to dismiss due to an allegedly incomplete package of documents, but the court found such grounds insufficient.
