IDAC INVESTIGATOR GRILLED: “YOU ARRESTED PEOPLE OVER WHAT SHE MIGHT DO IN FUTURE?”

An IDAC investigator faced intense questioning over how an alleged irregular Crime Intelligence appointment escalated into corruption charges, arrest warrants and a criminal prosecution. During the proceedings, commissioners challenged the investigator to explain what evidence showed that the appointment amounted to gratification under the Prevention and Combating of Corrupt Activities Act. The investigator suggested that the employee could potentially have been expected to perform an unlawful act in the future. This prompted a sharp response from the commission, which questioned how arrests and a prosecution could have followed when the alleged future act had not been clearly identified. “You formulated a charge, you got a warrant of arrest, you got people arrested… on the basis of something that you say, ‘maybe in future she was going to do that,’” the investigator was told. The hearing also established that the interview panel recommended the candidate, while the National Commissioner ultimately approved and signed off on the appointment.
