PRETORIA OR CAPE TOWN? IDAC AFFIDAVIT SPARKS DRAMATIC COMMISSION SHOWDOWN

A dramatic moment unfolded at the Madlanga Commission when Senior IDAC investigator Brian Padayachee was confronted with apparent inconsistencies in an IDAC docket linked to the investigation involving Lieutenant General Dumisani Khumalo. The hearing quickly became tense as commissioners questioned conflicting dates, unexplained signatures and an affidavit that appeared to refer to both Pretoria and Cape Town as the place where it was signed and commissioned. One commissioner reacted bluntly, saying the explanation “doesn’t make sense”, as Padayachee struggled to clarify why a Pretoria office stamp appeared on an affidavit he believed had been commissioned in Cape Town. He ultimately said Chief Investigator Dillon Perumal would be best placed to explain what happened. The Commission also examined why a statement dated January 2025 carried a criminal case number registered in June 2025. Padayachee explained that IDAC first conducts a preliminary enquiry and only later registers a formal criminal docket once investigators believe there is a prima facie case. But the pressure intensified when commissioners compared signatures across the documents and questioned whether the complainant, Member of Parliament Fadiel Adams, may have signed in a section intended for the investigator. Padayachee initially offered an interpretation but later declined to make a final determination, saying he was not a handwriting expert and that Perumal must explain the signatures himself. The explosive exchange placed IDAC’s record-keeping and affidavit procedures under intense scrutiny, raising fresh questions about how the Khumalo investigation was assembled.
