PADAYACHEE LEFT EXPOSED AS COMMISSIONERS TEAR INTO IDAC’S KHUMALO CASE

Senior IDAC investigator Brian Padayachee came under intense pressure at the Madlanga Commission as commissioners tore into the legal basis, internal processes and decision-making behind IDAC’s investigation involving Lieutenant General Dumisani Khumalo and the appointment of Brigadier Mokwele. The emotional exchange centred on one critical question: Did IDAC have proper grounds and lawful authority to take over and pursue the case? Padayachee was pushed to explain how a Section 27 referral from Member of Parliament Fadiel Adams was assessed, who sat on the case intake committee and how IDAC determined that there were reasonable grounds to investigate. The pressure mounted when Padayachee admitted that he could not fully explain who constituted the committee or how it operated, saying those decisions were taken by senior management. Commissioners challenged him repeatedly, warning that serious allegations alone were not enough and that IDAC first had to establish reasonable grounds before launching an investigation. Padayachee also confirmed that IDAC requested several SAPS dockets linked to Adams’s complaints and took responsibility for some of the investigations. This triggered further questions over whether IDAC had formally taken over the cases, merely requested cooperation or asserted authority over matters already registered with SAPS. The testimony exposed major confusion around how the dockets were transferred, who approved the investigation and whether IDAC’s internal process complied with the NPA Act.
