La paradoja del periodismo: cuando una noticia falsa puede ser considerada veraz por la Justicia
The convoluted relationship between truth (if it exists), journalism, and justice contains a legal paradox that continues to generate controversy almost four decades after the Constitutional Court established a precedent on the concept of "truthful information." In Spain, a news story can contain errors, be false, and even cause reputational damage, and still be considered truthful by the courts. As journalist José Precedo explained on the program "Hora 25," the explanation lies in a landmark Constitutional Court ruling, 6/1988, which interpreted the scope of Article 20 of the Constitution, the one that protects freedom of expression and the right to information. In contrast to a strict conception of truth, the justices established that the veracity required of journalists does not equate to the absolute accuracy of the published facts.
