Payment, here, refers to the fulfillment of an obligation, whether pecuniary or not, resulting in the termination of the legal bond between creditor and debtor. This theory encompasses several aspects that ensure that payment is made correctly and effectively. First, it is important to highlight who the subjects of payment are. The debtor is the one who has the obligation to fulfill the payment, but the law allows third parties to also make the payment, as long as this does not harm the creditor. The third party may be interested or not interested (referring to the legal interest in the debt). In this obligatory relationship, we also have the creditor. The creditor is the person to whom the payment must be made. The creditor is the holder of the credit, and he is the one who can give the discharge (declaring that the debt has been paid). The object of the payment is that which must be delivered. The object will always be a human act, which can be to give, to do or not to do. It can be the delivery of a thing (such as an amount of money, or the delivery of a good), or the performance of an activity (such as the provision of a service) or even an abstention (that is, not doing something, for example - not building a wall).
