Japanese Communist Party member Mikishi Daimon questioned the dangers of upgrading the "Cabinet Intelligence and Research Office" (Naichō) to the "National Intelligence Agency," citing the possibility of information collected individually by various ministries and agencies being aggregated and used for purposes other than those intended. The bill would give the "National Intelligence Agency" the function of coordinating information activities as the secretariat of the "National Intelligence Council," and would aggregate personal information collected by various ministries and agencies into the council. Daimon pointed out that the bill poses a risk of allowing personal information collected by various administrative agencies to be aggregated without the consent of the individuals concerned, and that "there is a risk that the 'National Intelligence Agency' will use personal information with virtually no restrictions." Attorney Yuichi Kaido, a witness, responded, "That's correct," and explained that Article 7 of the bill "provides a basis for fairly forcibly acquiring information from various administrative agencies." Mr. Kaido stated that Article 7, along with Article 69 of the Personal Information Protection Act, which allows the use of personal information for purposes other than those originally intended under certain conditions, "could lead to the concentration of personal information collected by various ministries and agencies in the 'National Intelligence Agency'." He warned, "The bill should specify what information should not be acquired and what activities should not be undertaken. Otherwise, it will be impossible to avoid uncontrolled activity." Mr. Daimon then questioned the importance of establishing a third-party organization for intelligence activities and oversight by the Diet. Mr. Kaido pointed out that "a complex monitoring system is needed that combines various systems, such as the establishment of an independent organization that can judge whether clear norms regarding what information can and cannot be collected are being followed, to prevent intelligence agencies from causing human rights violations."
