He cited the case of the former Power Reactor and Nuclear Fuel Development Corporation (PNC) (now the Japan Atomic Energy Agency), which cooperated with the police and the Public Security Intelligence Agency to monitor and discriminate against its employees, and denounced the danger of strengthening the infringement of rights against "ordinary citizens." In the trial of the same case, it was established that the former PNC "determined the ideological tendencies" of its employees and ranked them, excluding employees deemed to be enemies from core duties and discriminating against them in promotions and raises. Mr. Yamazoe pointed out that one of the key documents in the determination of the decision, the "enemy determination table," listed employees with information such as "sympathizer" and "Japanese Communist Party," and stated that it was "based on information" from within the former Power Reactor and Nuclear Fuel Development Corporation (PNC), as well as from the Katsuta Police Station of the Ibaraki Prefectural Police, the Public Security Intelligence Agency, and the prefectural police. He pursued the matter, arguing that the court also recognized as fact that such information gathering and provision had taken place. Public Security Intelligence Agency Deputy Director Shimoda and National Police Agency Security Bureau Director Chiyonobu Kohei offered excuses, stating that they could not comment as the matter was ongoing litigation, but that they "did not believe they were deviating from the spirit of the law" and that they were "acting appropriately in accordance with the law." Mr. Yamazoe criticized the former PNC, a national institution, for investigating and discriminating against workers' ideological status, arguing that it violated the neutrality of public service and that "the police and the Public Security Intelligence Agency cooperated and jointly promoted discrimination, which is extremely serious." Chief Cabinet Secretary Kihara Minoru stated that intelligence activities "should be conducted appropriately in compliance with relevant laws and regulations," but he could not definitively say that the collection and provision of information concerning the former Power Reactor and Nuclear Fuel Development Corporation (PNC) was "lawful." Yamazoe criticized the government for pushing through the bill, claiming that the plaintiffs in the lawsuit were "ordinary citizens" and that the way intelligence activities are conducted "will not change," and that "it is absolutely unacceptable for them to further collect information and intensify infringements on rights without any awareness or reflection on the abnormal actions of intelligence agencies."
