The Voice - a constitutionally guaranteed existence?
This video explores the question of whether the Voice amendment, if passed at the referendum, would result in the continuing existence of the Voice being constitutionally guaranteed. What if Parliament does not pass legislation to determine how the Voice is comprised and operates? Can a court force Parliament to do so? If such legislation is enacted, could a future Parliament repeal it, without creating a substitute Voice? Could a court strike down such a law as invalid? What about the Inter-State Commission?
